The Gold IRA Rollover Guide: 401(k) to Gold Without Penalties

What can be rolled over

Traditional and Roth IRAs, old 401(k)s and 403(b)s, TSPs and most other qualified plans can move into a self-directed precious-metals IRA. The main constraint is active employer plans: many 401(k)s don't allow 'in-service' rollovers until you leave the job or reach 59½ — check your plan documents first.

Direct beats indirect, every time

A direct rollover (or trustee-to-trustee transfer) sends money straight from your old plan to the new custodian. Nothing is withheld, nothing touches your hands, no deadline applies, and there is no limit on how many you do.

An indirect rollover pays the money to you first. You then have 60 days to redeposit it into the new IRA or the whole amount becomes a taxable distribution — plus a 10% penalty if you're under 59½. Employer plans must also withhold 20% for taxes on indirect rollovers, which you must replace out of pocket to roll over the full amount. And you're limited to one indirect IRA-to-IRA rollover per 12 months. There is almost no good reason to choose this route.

The mechanics with a gold IRA company

In practice the dealer's rollover specialist handles the choreography: opening the self-directed account, generating the transfer request, and chasing your old administrator. Your job is to insist the transfer is coded as direct, keep copies of everything, and confirm the receiving account is titled identically (traditional to traditional, Roth to Roth) to avoid an accidental conversion.

Taxes and timing

Done correctly, a direct rollover is not a taxable event — you'll receive a 1099-R from the old plan and report the rollover on your return, with no tax due. Converting traditional money to a Roth gold IRA is taxable in the conversion year and deserves professional advice before you pull the trigger.
